Amendment To Stallion Service Contract For Transported Semen

1.      This contract made between Rancho Poco Loco LLC and (purchaser) _________________________________________ for the mare ______________________________________ stallion_______________ for the breeding season is an amendment to the stallion service contract.

The Purchaser may not substitute another mare without the consent of Rancho Poco Loco LLC. Embryo transfers are prohibited without the written consent of Rancho Poco Loco LLC.

2. The Purchaser agrees to pay the following fees:
1. The non-refundable booking fee stated in stallion service contract.
2. The balance of the service fee and unpaid expenses as described in the stallion service contract.
3. Payment of shipping and courier fees may be subject to change without notice.

All fees and costs must be paid before semen will be shipped.

3. Reservations for shipped semen:
1. Fresh chilled semen will be collected and shipped on breeding days only. This will be on an every other day basis. Breeding days start in February with even days, and continue through March. Then in April and May breeding days are the odd number days in the month.
2. All semen orders must be received by 4:00 p.m. C.S.T. the day before the requested collection date. Late orders are not guaranteed.
3. Semen orders will be filled in this order of priority.

1.      All mares on premises of Rancho Poco Loco LLC will be serviced first.

2.      If there is sufficient semen to fill all orders of a given day, the farm veterinarian will determine which orders will be honored. This decision will be based on the information provided by the Purchaser’s veterinarian.

3.      Rancho Poco Loco LLC requires that you notify the breeding manager when the mare first shows signs of heat.

4.      Rancho Poco Loco LLC also requires notification by the Purchaser’s veterinarian to Rancho Poco Loco LLC’s veterinarian the day before the desired collection.

4. Conditions
1. Semen shall be provided only to healthy mares in sound breeding condition as determined by a veterinarian.
2. In the event the mare is barren, open, not a maiden, Rancho Poco Loco LLC requires the submission of a recent negative intrauterine culture and biopsy.
3. In all cases, the veterinarian must certify that the mare’s immunizations for equine rhinopneumonitis (Equine Herpes Type 1) have been kept current.
4. All wet mares and maiden mares over 3 years of age are required to be examined by a licensed veterinarian by palpation and if possible also ultrasound.
5. Purchaser agrees to the mare examined for pregnancy by ultrasound and submit such results along with insemination and conception reports to Ranch Poco Loco LLC within 14 days after ovulation of that cycle. In the event the mare is barren, Rancho Poco Loco LLC may require the submission of a negative intrauterine culture and/or biopsy and/or progesterone assy.
6. Purchaser agrees to have mare examined for pregnancy by veterinarian at 28 days post ovulation and again at 60 days.
7. Purchaser agrees that chilled semen requires special handling and that attempts to breed any mare outside controlled conditions of an equine reproductive center can greatly reduce, and in some cases prevent, chances of conception.
8. Purchaser agrees to return all insemination certificates to the Breeding Manager within 30 days of insemination. Failure to comply could inhibit registration of resulting foal.

5. Return of Service
1. The Purchaser is entitled to 2 semen shipments per estrus cycle, for no more than 3 cycles per breeding season.
2. All terms within the stallion service contract concerning the live foal guarantee will be honored.

6. Non-Assignment

a.     This contract cannot be assigned or transferred by Purchaser.

7. Liability
1. Rancho Poco Loco LLC is not responsible for lost, delayed, or damaged semen and makes no representatives or warranties of any kind with respect to semen expect that it is the stallion’s and is viable semen at time of shipment.
